1103 Civ Pro midterm exam tomorrow! Th. Oct. 21, 10am

Hello Students!

I hope you are surviving midterm week.  Just a reminder!  TOMORROW (Th. Oct. 21) you’ll take your LAW 1103 Civil Law and Procedure midterm exam in our regular classroom, starting 10am.  Once again, you are welcome and encouraged to bring your copies of the court system maps and charts to reference during the exam (linked under “Class notes & materials”), and please don’t bring any notes, quizzes, textbook pages, or other materials because you may not use them. 🙁  You will not need your CPLR.  Please also bring a writing instrument!  Of course, be sure to study.  Here are some study suggestions!

1101 midterm exam tomorrow! (Tues. Oct. 19, 10am)

Oct. 19) you’ll take your LAW 1101 Intro to Paralegal Studies MIDTERM EXAM!!  We’ll meet 10am in our regular classroom to start, and you can leave whenever you’re finished.  You are welcome and encouraged to bring your copies of the court system maps and charts to reference during the exam (linked under “Class notes & materials”) but please don’t bring any notes, quizzes, textbook pages, or other materials because you may not use them.  🙁  Please also bring a writing instrument!  And definitely STUDY!  Here are some study suggestions.

Get info about Penn State Law School!

Hello Students!  Below are some free online events taking place this week for Penn State Law School, which is where Lance Smith, the defense lawyer who graduated from our program whom we met at the federal court a few weeks ago, earned his degree.  Even though law school is a few years away for you, you might find the information useful if you think you might want to attend!  If you do attend, let me know, I’m interested to know what you think of it.

Quiz grades & keys posted, feedback on resumes & letters!

Dear Students!

GREAT WORK today peer-reviewing cover letters, and on the quiz, and our midterm exam review!  Quiz grades are now posted in the “GradeBook” here, and the keys for today’s and all our quizzes are posted in the “Answer Keys” tab.  Please use them to study for the midterm exams!

THANK YOU to each of you who submitted draft resumes and cover letters.  I’ve now sent comments to each of you, so no need to let me know you want them, as I asked you in class.  If you submitted a draft resume and letter, and didn’t receive comments, let me know.  Otherwise, I will not be able to send any more comments before the deadline for final versions of the documents, which is now Monday, Oct. 18.  (See “Assignments” tab for details.)  When finalizing your documents, please feel free to review the samples in our textbook and that we reviewed in class, all posted under “Class notes & materials,” for ideas!

Cover letters due 8am! 1103 quiz #2 in class!

Dear Students!

I hope you enjoyed your LAW- class-free day yesterday.  Thank you for completing 1101 Intro quiz #2 on Blackboard!  Most of you did quite well, your scores are available on Blackboard and in the GradeBook here on OL.

DON’T FORGET, tomorrow (Th. Oct. 14) by 8am, please email me your draft cover letters!  We’ll review and provide feedback on each other’s letters FIRST, so please arrive on time to benefit from your classmates’ suggestions.  I have posted some additional sample cover letters here in the “assignments” tab, and I posted the resumes we reviewed in Thursday’s class (yours and peer mentor Oliver’s) in “Class notes & materials” for Thurs. Oct. 7.  PLEASE email me your letter as an attached Word document, NOT a link to Google docs or any other “cloud.”  Your final cover letters and resumes, to be graded according to the rubrics in the assignment, are due Friday Oct. 15.

Tomorrow you’ll also take 1103 Civ Pro quiz #2 in class!  PLEASE bring your copies of the maps and charts of the court system to use during the quiz, and when we review for both midterm exams.  You do NOT need to bring your CPLR tomorrow, or any day until after the midterm exams!  Please also bring any questions or topics you’d like to review!

I am leaning toward giving next week’s midterm exams in class, on paper, during the regularly scheduled class time.  If that poses a significant hardship for anyone, let me know and we can discuss it.  Otherwise we’ll discuss this generally in class tomorrow, and I’ll be glad to consider your feedback.

Legal News: Olivia Rodrigo vs Copyright Police

The article I have chosen to comment on, titled Olivia Rodrigo, Paramore, and the murky tides of copyright infringement, was written by Kirbie Johnson for Dazed Digital on September 7, 2021. The article covers a recent topic of conversation in the music industry surrounding Olivia Rodrigo’s album Sour and the vast amount of similarities between her recent music and artists including Paramore, Taylor Swift, and St. Vincent. The main focus of the article is Rodrigo’s single “good 4 u” and its striking resemblance to Paramore’s “Misery Business”. Throughout the article, Johnson discusses the confusing, yet fine, line between copyright infringement and inspiration when it comes to new music. After releasing her album, Rodrigo retroactively added writing credits to a few of her songs because of the buzz around the similarities in previously released music. In doing so, she is handing over (or sharing) songwriting credits and the compensation that comes along with it. The article goes over not only the Rodrigo discussion but also talks about how this never-ending discussion gets different answers and thoughts depending on who you ask.

In my opinion, I think it is a very difficult decision to make. There are many laws and rules in place to prevent the straight-up copying of an artist’s songs. There are even ways to work around it in a legal way through sampling and interpolation. With that, how will any song sound completely different? A quote that stuck out to me in the article was the line, “Does evoking a similar ‘feeling’ really warrant possible litigation, credit, and compensation?” Especially now with so much past music in the worldwide discography, it is hard to say what is straight-up copying and what just sounds similar. Especially in pop music, there are well-known chord progressions that are widely used. Do I think Rodrigo was somewhat backed into a corner and felt forced to add the credits? Yes. In one of her other songs, she did initially include credit to Taylor Swift for interpolation. One would think that if she intentionally and actually “copied” a previous artist, she would have known to credit them. Do I also think “good 4 u” sounded very similar to “Misery Business”? Yes to that too, but I think it was more along the lines of inspiration. If the whispers were not out there about the similarities between the two songs, I cannot say I would have made a connection (and I am a huge Paramore fan!!).

Tue. Oct. 12 – No class! Quiz & assignment instead!

Good morning Students!!

Just a reminder, today (Tue. Oct. 12), we will not meet in class nor on Zoom!  To be considered “present,” please (1) complete LAW 1101 quiz #2, available on Blackboard for you to complete during any one-hour period until 11:59pm, covering everything since quiz #2, particularly court systems (M&M ch. 6) and career opportunities/resumes & cover letters (M&M ch. 2); and (2) please read M&M ch. 2 pp. 38-43 including the sample cover letter, and review the sample cover letters posted in the “class notes & materials” tab under Tue. Oct. 5.  Then, by Th. Oct. 14 at 8am, you’ll prepare and submit a draft cover letter to my email, as explained in the resume & cover letter assignment.

Law Office

The law office I might like to work is Law Offices of Robert Tsigler, 299 Broadway, Suite 1400 New York 10007. I would like to work in this firm because on their website and they have a tab named criminal defense under that tab I saw Drug crime lawyers. where they deal with drug crime and give you a run down if you are a first time offender you can face 1-2 years in prison and if you are not a first time offender you can face 15 to life in prison. They also state that if you are wrongly accused of a crime they got you. they will hear you out and give you the results you deserve.

Law Office

The office I have chosen for my assignment is the legal department of Universal Music Group. The New York office is located at 1755 Broadway # 6, New York, NY 10019. UMG is a “music-based entertainment” company with offices around the world. It includes the record labels Republic Records, Island Records, Def Jam, and even a publishing sector called Universal Music Publishing Group. According to the reading, the company would be considered a corporation. The department within the company I would like to work in is the Business and Legal Affairs Department as a paralegal/legal assistant. The department deals with any legal aspects or issues from all the different labels and sections within the umbrella company UMG.

I actually found a listing for the position I would like to start out in online! It was for the Santa Monica office but I believe the tasks would be the same if not similar for the New York office. Tasks included reviewing contracts, researching claims, assisting in responding to items including discovery requests and subpoenas, maintaining filing systems, preparing documents, and more.

Law Office

A Law office I would like to work at is called Law Firm of Dayrel Sewell, PLLC.  They specialize in Real Estate Law, Corporate Law, and High Profile Patents like Social Media influencers. This Law firm is located at 599 E. 2nd in Brooklyn, NY. They claim that their work ethic is nothing matched to other law firms.
