Court Observation

On April 18, 2023, I went to the highest court in the state of New York.  Which is the “New York Court of Appeals” located in the capital of the state Albany, NY.  I had the opportunity to go to this court on a field trip organized by the NY City Tech Law and Paralegal Studies department.

The case I observe that day is People v Tyquan Johnson.  The appellant’s lawyer is named Paul B. Watkins, while the name of the respondent from Monroe County Assistant District Attorney is Martin P. McCarthy, II.  The Joint Judges that were proceeding with the case are Judge Singas, Judge Rivera, Judge Garcia, Judge Cannataro, and Judge Troutman.

Tyquan Johnson was arrested by a police officer because of drug possession. Johnson was then convicted of two counts of third-degree possession of a controlled substance and one of marijuana possession. The Supreme Court denied Johnson’s motion to suppress the evidence. The Appellate Divison, Fourth Department affirmed the Supreme Court ruling.  Johnson was appealing his convictions to the state arguing that the drugs recovered from a search and seizure by a Rochester police officer should be deemed unlawful and the evidence should be suppressed.  In Court, both lawyers were arguing about the four levels of police encounters.  The appellate attorney Paul Watkins argues that the Rochester officer didn’t have levels three and four against his client Tyquan Johnson.  On the contrary attorney Martin McCarthy II, argue the officer did have those levels, based on the movement of Johnson inside his vehicle.

My reaction to the case is that law enforcement will say anything necessary to try and arrest a person.  It’s interesting to see how cases from the lower courts get brought up to the highest court in New York.  To see how much time lawyers have to argue their case in the New York Court of Appeals is fascinating.  From this trip, I became keen to pursue a career in becoming a Judge in the New York Court of Appeals.  I enjoyed the fact that the Judges were the one’s arguing with the lawyers about the facts in the case.

 

 

 

A Handmaid’s Tale

The book I chose for my “Law in Culture” review is called The Handmaid’s Tale by Margaret Atwood.  The book was published in the year 1986.  Anchor Books released its edition of the novel in the year 1998.  The ISBN for the book is 978-0-385-49081-8.

The Handmaid’s Tale is a book set in a dystopian America.  Where The Republic of Gilead has taken over parts of the country.  The objective of the state is to have females reproduce for the sake of the government. The government will do everything in its power in order to try and achieve its goal. The protagonist of the story is Offred.  Throughout the novel, Offred recalls stories about her past, stories about her time spent at the Red Center (an educational institution for prospective Handmaids), and stories about her time with her assigned Commander and the household.  Offred endured many hardships with the government, but she has received her luck of shares as the novel progress.

In this novel, we as readers can see how a government creates a society that favors them and not the people.  In this case, we can see how women’s rights have been abolished and their right to freedom is no longer capable.  The right to abortion is no longer in their favor (In today’s world we are experiencing how females’ rights are being abolished in certain states).  There is no longer a need for courts in this book, if the government finds a person deemed to be a threat to the state they would simply be hanged on ” the Wall” (31).   For example, doctors have deemed criminals in the novel and the government would consider the practice of abortion illegal.  This sort of action from a government will destroy all past precedents and gouge case laws that were established.

After reading this novel, and seeing what is happening with women’s rights.  I feel that it’s important to implore future judges and lawyers to fight for an equal society. I encourage my classmates to read this novel, so they can read what sort of struggle a woman will go through if their rights to freedom have been stripped from them.  Lawmakers should be wary of how decisions on the sort of law to create could impact society.  We all come from a woman’s womb, some are grateful for the life they have been given, others not so much.  In the end, we as a society have to at least understand that all women should have the right to choose to have an abortion or not.

Took my “Civil Law and Procedure Law” midterm exam; Questions based on chapters 1-5 from “Civil Practice For Paralegals In NYS” -0.75

Workout in the gym; Monday is pull day; Exercise routine for pull day includes the following: Deadlift, pulldown, cable row, facepulls, superset of hammer curl and  dumbbell shrugs, and standing cable curls -1.0

Walked to Starbucks and order a single espresso -0.25

Sat down and read a few pages of the book “The Handmaid’s Tale” by Margaret Atwood -0.25

Commuted back home to Brooklyn by train (Q train) -0.50

Reaction: To me, it’s not a difficult task to keep track of my time on a daily basis.  I plan out my life based on what is going to be, prior the day before.  It makes it easier for me to follow a routine each day.  For example, adding time to go to the gym, while going to school or going to work.  I felt that this sort of planning can help an individual create a routine for their lives.  Hopefully, this sort of timekeeping will help me become a successful paralegal and lawyer in the near future.

 

The Handmaid’s Tale

For my “Law in Culture” review assignment, I have chosen a book.  The book is a source that I’m reading in my ENG 3401- Law through Literature.  The name of it is “The Handmaid’s Tale” by Margaret Atwood.  The year of Publication date is 1985.  According to Wikipedia,  the setting of this story takes place in the “near-future”.  Where the United States government has been overthrown by another government.

The Office of Cooley LLP

After doing some research on the internet, I’ve decided I would like to work for the company of Cooley LLP.  According to it’s Wikipedia page, Cooley’s headquarter is located in Palo Alto, California.  Cooley has different offices in other locations, which include big cities and overseas.  I would like to work in the office here in New York City.  The address of the office is 55 Hudson Yards New York, NY 10001.  The company is a large firm that specializes variety of laws.  For example, Cooley offers help in corporate, litigation, regulatory, and intellectual property.  The reason I chose this company, is because the specializiation in corporate law.  Another reason, since it’s a big commpany with many different offices, there is a chance i could relocate to a different city or country.  But the office here in New York City, is loctaed in a great area.

Who I Am

Hello, fellow classmate, my name is Francisco Castillo.  I recently transferred to New York City College of Technology from John Jay college.  My purpose for enrolling in Law and paralegal studies at this school is the continue my dream of becoming an Attorney for the City of New York.  I plan to graduate from this college, I feel that this college will help me advance my studies in learning what a lawyer does for a living.  For example, the sort of laws that an attorney tends to specialize in, what is their role in the courtroom, etc.  New York City College of Technology classes intrigue me as well, I couldn’t believe the variety of courses the school has to offer.  Other than my education, I have other interests.  I love sports in general, I love to go to live sports events here and there.  I also enjoy going to the gym, it gives me the energy I need to get me through the day.
