Ethical Readings
The readings that we have been assigned are an eye-opener for me. I can not recall a time in the past when I have used another’s creative work but if I were to I would credit them. Whenever I start designing I would do extensive research on what I’m doing as well as looking at other creatives and designers’ work for inspiration. The Fairey Copyright Hope Poster case presents a complex and nuanced intersection of legal, ethical, and artistic considerations. Shepard Fairey’s assertion of fair use raised crucial questions about the transformative nature of his work. By repurposing and altering the original photograph of Barack Obama, Fairey arguably created a new and distinct artistic expression with its own cultural and political significance. The Associated Press (AP) had legitimate concerns regarding copyright infringement and the unauthorized use of its photograph. As the copyright holder, the AP held exclusive rights to reproduce, distribute, and display the original image. : This aspect of the case underscores the tension between an artist’s creative vision and the legal rights of copyright holders.
